Photo Release Terms and Conditions

By uploading photographs to XcortsUSA.com (hereafter "Website"), You are agreeing to these Terms and Conditions of Use.

1. The parties to this Agreement (the "Agreement") are You, (the "User"), and xcortsusa.com, LLC. (the "Company"). As used in this Agreement, the terms "we" and "us" are used interchangeably to refer to the Company and the Website; the term "You" and "Your" is used to refer to You, the User.
2. You, or the person or persons whose photograph or photographs were taken if the person in the photograph or photographs is not You, was at least 18 years of age at the time any photograph You are uploading to the Website was taken.
3. You are the sole owner of the photograph or photographs You are uploading to the Website with rights to display said photographs on this Website for the purpose of advertisement.
4. If You are not the sole owner of the photograph or photographs You are uploading to the Website, You have the expressed written permission from any and all other owners of the photograph or photographs for the purpose of displaying them on the Website.
5. You acknowledge the right of the Website to edit or remove from the Website any and all photographs and any other content You may upload to the Website without any prior notification to Yourself or any other third party for any reason whatsoever.
6. You acknowledge that any content You upload to the Website is subject to the community standards of federal, state, and local laws of the United States and other countries, and that the content You upload does not solicit or encourage illegal activity either by persons under the age of majority (eighteen (18) years of age (twenty-one (21) years of age where eighteen years is not the age of majority)) or by persons who live in places where the content You upload may be in violation of community standards.
7. You further represent, affirm, and warrant that You are currently over the age of eighteen years (18) of age (twenty-one (21) years in places where eighteen years is not the age of majority) and are capable of lawfully entering into this agreement.
8. You agree to be personally liable and fully indemnify the Company and its successors and assigns for any and all damages directly, indirectly and/or consequentially resulting from any lawsuits, fines, attorney's fees and costs, including, without limitation, damages resulting from prosecution and/or governmentally imposed seizure(s), forfeiture(s), and/or injunction(s) that are caused by content uploaded by You.
9. You acknowledge and agree that You are solely responsible for any information You send, display, or receive through the Website even if a claim should arise after termination of service.
10. You agree to abide by any and all conditions stated in the Terms of Service that are not already included in this agreement.
